Limitation of Liability
The total and aggregated liabilities of Funtech in respect of any claim or
legal proceedings, whether based on the laws, contract, or otherwise, resulting
from or in connection with our works and duties, failure, omission, act,
mistakes, negligence, breach of agreement or laws, the manufacture, sale,
delivery, warrantee, repair, replacement or use of all Products delivered to
you, loss of profits, loss of business, loss of clients or market, loss of
goodwill or reputation, or the performance of any activities/service, shall not
exceed the price you paid for relevant Products, item and service. You hereby
accept to irrevocable waive and release us from any and all additional losses,
damages and compensations of whatever nature in relation to our above legal and
contractual obligations.
Miscellaneous
You authorize us to use, store, copy or disclose your information and
documents, including your name or other personal information, your address, and
contact details, in whole or in part, within the limitation of the laws.
You hereby warrant that you are eighteen (18) years of age or older and
have every right to contract in your own name in the above regard.
You agree that Funtech will use service providers (i.e third parties) to
provide and deliver the Products/Services, thus, a failure, delay or violation
may occur for reasons that are beyond Funtech control. Funtech won’t be liable
for the outcome, damages or losses resulting from any such
failure/delay/violation. In addition, by clicking the submitted button hereof,
you irrevocably agree to the policies, terms and conditions of the above-mentioned
service providers, including the Product’s manufacturer, shipping and delivery
companies/entities.
While we reasonably endeavor to provide the services or products that are
shown on our website, we make no representation or warranty, express or
implied, about the completeness, accuracy, reliability, suitability,
availability, fit for purpose, free from error or virus or spam or threat or
unauthorized access or alike. We won’t be liable for loss or damage, being
direct or consequential, loss of profit, business or for special, consequence,
incidental, indirect, reliance or exemplary damages, either under the contract
or law, arising out of or related to our obligation hereunder and/or shortfall
in performance, defective performance, non-performance, interruption and/or
discontinuance of service, error, virus, spam, threat, compromise, unauthorized
access, illegitimate control, or alike. This article is applicable
notwithstanding anything to the contrary stated under these terms and conditions
or under the laws.
You shall be the full and sole responsible to take all
actions and procedures for the protection of your information, data, documents, bank accounts, payment
methods, hardware, software, website
accounts, and systems (Collectively referred to as “Systems”) against
any cyberattack, which includes without limitation, any attempt to access, change, use, steal, expose,
alter, disable, collect, disrupt, deny, damage, degrade, blackmail on Systems
(as defined above). This includes all
kinds of non-authorized access, malicious activity, adware, ransomware,
rootkit, keylogger, virus, trojan,
worms, spyware, or other code or mechanism designed to permit unauthorized
access, or which may restrict your access to Systems. We will not be
responsible for any such threats, acts and cyberattack.
